Summary

In August 2025, the Gujarat High Court disposed of a public interest litigation (PIL) filed in 2021 against the acquisition of grazing land for the expansion of the Mandvi airstrip in Kutch, but directed the local Gram Panchayat and the district administration to identify alternative grazing land closer to the affected villages.

The PIL was filed four years ago by Kathda Gram Panchayat, Gau Seva Trust and representatives of Mandvi village after the state government initiated steps to extend the Mandvi airstrip runway. The expansion was aimed at allowing larger aircraft such as the state government’s Challenger 650, ATRs and Bombardier planes to land, boosting both tourism in Kutch and strengthening border security. At the time, the project faced technical hurdles, as the site was flanked by the royal palace on one side, the sea on the other, and dense construction along the landing approach.

In 2024, the project triggered sharp protests after 235 acres of gauchar (grazing) land in Kathda village were formally allotted for the airstrip. In exchange, the government earmarked land in another village, nearly six kilometres away. The Kutch District Sarpanch Association opposed this move, warning that cattle-based livelihoods, central to Kutch’s rural economy, would be badly hit.

According to the 20th Livestock census, Kathda village alone had nearly 3,000 animals, including cows, buffaloes, goats, sheep and camels, with local dairies generating over Rs 3.6 crore annually. Villagers argued that the newly allotted land was saline, unfit for fodder and too far for cattle to graze. “We are not against development, but taking away grazing land is against humanity and law. Gauchar will remain only on paper if such policies continue,” the association told ETV.

Petitioners told the High Court that while they were not opposing the airstrip project itself, the government had violated their rights by allotting replacement land nearly kilometers away, making it impossible for villagers to sustain animal husbandry.

A bench of Chief Justice Sunita Agarwal and Justice Pranab Trivedi declined to interfere with the expansion project, terming it one of “national importance” linked to defence infrastructure. However, the bench acknowledged the villagers’ difficulties and directed the Gram Panchayat to pass a resolution identifying nearby suitable grazing land, which the Kutch Collector must consider and decide upon at the earliest.

The state government, in its submissions, disputed the villagers’ claims, stating that the new land was only 2.5 to 2.9 km from Kathda and 5.3 km from Mandvi. It further argued that 'gauchar' land was not village-specific but part of a common pool that could be shared across villages.

The High Court, while disposing of the matter, reminded the state that under the law, whenever 'gauchar' land is acquired, an equal extent must be allotted back to the affected village. It also observed that in Kutch’s harsh climate, even 5 km of additional distance effectively doubles for animals and could disrupt rural livelihoods.

With this judgment, the Mandvi airstrip expansion will proceed, but the onus now lies on the Gram Panchayat and the district administration to resolve the long-pending issue of grazing land. How this balance is struck between development and traditional livelihoods will determine whether local resistance eases or continues.
