Summary

Around 500 residents of Batla House (Muradi Road), Abul Fazal Enclave, and surrounding colonies in the Okhla area of South-East Delhi are living in constant fear of being evicted. On 22 May 2025, the Uttar Pradesh Irrigation Department asked residents to remove their structures from its land at Khasra 277 within 15 days, warning of legal action for non-compliance. Days later, the Delhi Development Authority (DDA) issued eviction notices to residents of unauthorised colonies in the Batla House area in Delhi's Okhla to vacate their homes build on encroached land at Khasra 279.

This comes weeks after the Supreme Court issued a directive to the Delhi Development Authority (DDA) on 7 May 2025 to carry out a demolition drive to raze unauthorised structures spread over more than 2 bighas of public land in Okhla villages as per the due process of law within three months.

The eviction notice issued by the Uttar Pradesh Irrigation Department stated, “This is to inform the general public that in Village Okhla, at Khasra Number 277 (Khizar Baba Colony, Muradi Road), Delhi, land belonging to the Irrigation Department of the Government of Uttar Pradesh has been illegally encroached upon, and permanent houses and shops, have been constructed. Remove these illegally constructed houses and shops within 15 days. Else, in the event of any damage/harm, you’ll be solely responsible.”

These notices triggered widespread fear among residents, many of whom claim to have have lived in the area for over 60 years. In a petition filed at Delhi High Court, petitioners claimed that they have been living in the area since 1980-82 and they possess documents such as electricity bills, property tax receipts, sale deeds, and voter IDs. Residents include daily wage workers, shopkeepers, students, retired employees, small businesses and low-income families.

On 30 May 2025, the Delhi High Court granted temporary relief to 115 families in Okhla by stopping the Uttar Pradesh Irrigation Department from evicting or demolishing their homes. The court asked the department to file its reply and listed the case for the next hearing on August 4.

Separately, 23 June 2025, the Delhi High Court reserved its judgment on a series of petitions contesting the demolition notices issued by the DDA for allegedly unauthorised properties in the Batla House area of Okhla, South-East Delhi. Previously, the High Court had granted interim stay on the demolition of 25 specific properties in Batla House (Case No. W.P. (C) 8475/2025), directing the DDA to submit its response by 10 July 2025.
