Summary

Although discussions about the Jodhpur-Pali-Marwar Industrial Area (JPMIA) in Rajasthan started a decade ago, it was only in October 2020 that the Pali District Collector officially transferred all government land from nine revenue villages to the JPMIA Development Authority. The nine villages, namely Dungarpur, Singari, Dhundhali, Doodali, Neembli Patelan, Neembli Bramnan, Danasani, Rohat and Dalpatgarh. The land was meant for the development of an industrial park, part of the larger Delhi-Mumbai Industrial Corridor (DMIC).

In 2021, all the villagers of Dungarpur filed a case against the transfer of 864.6148 hectares of "public utility" land which included land reserved for gauchar (pasture), agor (water catchment areas) and orans (sacred groves) to the JPMIA Development Authority. The petitioners argued that since the land was under the Gram Panchayat’s jurisdiction, the local authority should have been given a hearing before the transfer was made. They argued that public lands, distinct from government land and meant for essential community services, should not be allocated for industrial use as they are legally protected from land-use changes. Lastly, they evoked the violation of sustainable development as they believed the transfer would cause the destruction of natural resources/habitat.

However, the Jodhpur High Court dismissed their claims in April 2023, stating that the villagers failed to prove the land belonged to agor and orans. With the industrial authority providing alternative gauchar land, the court ruled that the matter was resolved. However, the Social Impact Assessment report under the the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013, says otherwise. It talks about the loss of common community resources like grazing land for the cattle, small open water bodies around the affected villages, trees near the agricultural land which might act as a source for fuel for the villagers, medicinal plants, common wells used for household purposes during acquisition.

As per Jagdish, a resident of Dungarpur villages, other problems arose last year. While alternative grazing land was provided 10 km-20 km away, families who had lived on gauchar land for over 40 years, rearing livestock and built homes, were not rehabilitated. Many villagers, unaware they had settled on government land due to population growth, now face homelessness.

He said even bigger problem was the way private khatedari land (where tenant has heritable and transferable rights) was being acquired. He claimed that the District Level Committee (DLC) rate has not been revised in 10-15 years. "Authorities are offering us Rs 28,000 per bhigha (0.25 hectares) against the market value of 5 lakh per bhigha," Jagdish added. The resettlement and acquisition is still ongoing and the construction of project estimated to be built at cost of Rs 922 crore hasn't started yet.
