Summary

In October 2024, statewide protests erupted in Karnataka after the state Waqf board issued notices to farmers to vacate their ancestral lands, claiming ownership of 1200 acres of land in Honwad in Tikota taluka of Vijayapura district.

Holding their land records and registered deeds, farmers alleged that land records in Tenahalli village in Indi taluka and Honwad village in Tikota taluka were changed without their knowledge and marked as Waqf property.

As the state opposition party alleged political misuse of the Waqf Adalat system chaired by Minister Zameer Ahmed Khan, the ruling party clarified that the confusion stemmed from an error in a gazette notification that designated 1,200 acres of land at Honwad in Tikota taluk of Vijayapura district as Waqf property.

In the gazette notification of 1974, the name Honwad was mistakenly added in the brackets after Mahalbagayata, another village in Vijayapura, where Waqf property does exist. The Waqf board acknowledged the mistake in the 1974 gazette, and corrected it in 1977 by removing “Honwad” from the record. However, in Indi taluk, a tahsildar updated the land records (in column 11 of the Pahanis) for 41 properties without issuing prior notice, violating protocol.

Vijayapura district in-charge minister MB Patil said that only 11 acres are genuinely Waqf property. These 11 acres are in 10 survey numbers, and have a burial ground covering 10 acres and 14 guntas, with an Idgah, Masjid, and other structures on the remaining 24 guntas. He pointed out that Waqf-related Acts did not amount to taking over of properties, but the Waqf board could only enter a claim in column 11 of the Records of Rights, Tenancy and Crops (RTC). The name of the owner would remain in column 9 of the RTC. He has also said a task force would be constituted to verify the status of these lands between 1964 and 1974.

The government further said that affected farmers can present land records predating 1974 to the Assistant Commissioner, and any lands verified as legitimate will be denotified. The Deputy Chief Minister also directed the withdrawal of all notices issued and assured that farmers' land will remain with them.

The farmers suspended protests on good-faith assurances after submitting a memorandum to the Joint Parliamentary Committee evaluating the Waqf (Amendment) Bill 2024. However, the implementation is yet to be seen to be completed.
