Land Conflict Summary

Villagers of Malaichapada in Maharashtra's Dhule district protested against the transfer of government land to a de-addiction centre and the construction a boundary wall around the village in 2020.
During the protest, the villagers obstructed the construction work and blocked the highway to stop the work. A government official told the villagers that the land belonged to the Government of Maharashtra and it was being given to Vishwa Manav Ruhani Kendra. However, the village falls under the Panchayat Extension to Scheduled Area (PESA) Act of 2005 making the mandate of gram sabha compulsory for any construction work. The gram sabha of Malaichapada later submitted a memorandum to collector and State Schedule Tribe Commission to stop the illegal construction. The construction was thereafter halted because of protests.
The villagers also sent a letter of complaint to the State ST Commission and sought a meeting with Maharashtra's Ministry of Tribal Affairs. There were no fresh attempt to reconstruct the boundary wall since the complaints were filed. 
The villagers also alleged that the non-governmental organization (NGO), which started its work in Pimpalner in 2005, has been expanding its boundaries and conducting mining activities beyond its mandate in the area. They claimed that the organisation took more land near the centre for afforestation but the barren hill is being quarried for stones by the organisation. This could also be seen from the site visit conducted by a LCW researcher. They also raised concerns over the centre employing children and not the villagers in their agricultural fields and mines.
The state government had acquired the land from villagers in Lathipada (Pimpalner**) **in 1969 for the construction of Panzara Dam on Panzara river near Sakri in Dhule district. In 1974, the dam construction was completed and the housing quarters were vacated by the workers. The site remained vacant for five years after which in 1980, the site was given to Vishav Manav Ruhani Kendra.
One of the adivasi residents of Lathipada, Devrav Tuliya Bhil, had to give up her land bearing CTS no. 1066 in Pimpalner village for the project according to the 7/12 land record obtained from the Tehsildar office. This land was used for the construction of housing quarters for workers and engineers stationed in the village for the construction of the dam. 
The 7/12 registration of the organisation claims that only the structures built as quarters were given to the organisation for the purpose of setting up a de-addiction centre. It was not given any permission for agricultural and mining activities. However, a site visit to the village revealed that the organisation has a large agricultural field, which is cultivated multiple times every year. 
The villagers are now campaigning to close the Vishwa Manav Ruhani Kendra and give back the land to gram sabha of Pimpalner and Malaichapada.
