Summary

On 29 December 2025, the Morigaon Revenue Circle Officer issued eviction notices to nearly 1,000 residents in areas like Dahuti Habi and Morigaon revenue village, citing illegal occupation under Sections 163 and 164 of the Assam Land and Revenue Regulation, 1886. The notice called upon to submit the required documents and proofs for asserting their land rights in the tribal sector within 15 days.

Affected individuals claimed legal possession via sale deeds, power of attorney, and agreements and filed writ petitions challenging the notices.

Petitioners said that they have been residing in the village of Morigaon and Dahuti Habi revenue village under the Uttar Khula Mouza in the district of Morigaon for the last several years. They added that they purchased these lands, and are its legal occupants. They argued that original pattadars have allowed them to act and live on the land they occupy due to the power of attorney and other documents. 

On 28 January 2026, Justice Soumitra Saikia stayed the eviction drive, directing the Morigaon Deputy Commissioner to hold individual case-by-case hearings starting 9 February 2026 and complete the hearings within 30 days (extendable by 15 days). It asked petitioners to appear (or via representatives), with adequate opportunity to present documents and replies.

This follows earlier interventions in October 2025 when the High Court quashed Forest Department eviction notices affecting nearly 1,000 families in villages including Katahbari, Kalapani, and Maligaon, citing failure to establish land as forest or revenue and lack of due process. Interim stays were granted, one until 19 August 2025, amid scrutiny of land status. The court warned of stringent action for violations and stressed adherence to judicial process.
