Summary

On 21 April 2025, the Archeological Survey of India (ASI) served eviction notices to 206 house owners in Haryana’s Polad village and instructed them to vacate the houses as soon as possible. The ASI stated that 48.31 acres in Polad is a protected site since 1925 and current occupants have no legal right.

The eviction order was issued the special ASI court under the Public Premises (Eviction of Unauthorised Occupants) Act, 1971, which allows the government to evict those unlawfully occupying public property.

Villagers say they settled here during the India-Pakistan partition and have lived here for the past 77 years. No one has land registration because the plots were bought for Rs 5–10 back in the days, which was below the registration threshold of Rs 100. The eviction notice mentions that ASI bought the land in 1926 after paying compensation.

Polad has approximately 2,000 voters and a population of 6,000. The majority of the population in the village belongs to the Scheduled Castes.

Residents add that government projects like construction of schools, temples have continued in the village, but still "every few years, ASI threatens us". “Many of my generations have been living here, but now the eviction notice has brought fear among all” a resident told ETV Bharat. He also said that most of the settlers did not have the land ownership rights but they have been living here since 1947.

The land also has historical significance. According to historians, this site was the place of penance of Ravana's (from the ancient Hindu epic, Ramayana) grandfather, Pulastyamuni and that Ravana spent his childhood at this very place.

Residents say that the ASI has conducted excavations several times in the past, where it uncovered 465 artefacts, including coins and clay-copper vessels. ASI believes this was a Mahabharata-era village destroyed in the Pandava-Kaurava war.

This is, however, not the first time that the residents have received eviction notices. The ASI has been sending notices since 2005 and has also sent similar notices to the villagers in 2016 and 2018. Quoting official documents, ETV Bharat reported that the ASI claimed that the respondents (villagers) failed to appear before the hearings and no lawyer represented the villagers’ side allowing the ASI to have ex parte proceedings.

Meanwhile, the villagers say that they have been fighting since they got the eviction notice for the first time. They also formed the ‘Polad Bachao Sangharsh Samiti’. Lawyer SS Momi, representing the Polad Panchayat told Bhaskar, "Hearings began in 2018, but often didn’t happen due to absent officers. COVID caused more delays but no notices has been issued since then, until now in April 2025."

The lawyer added that villagers do not oppose excavation drives from the ASI but object to eviction from the village. “We will file legal applications, approach the High Court if needed, and appeal to the government to release the land in the village’s name, especially since facilities like schools and roads were provided by the government,” Momi told Bhaskar.
