Summary

At least 98 families residing at H Block of Mumbai Port Trust are facing not only eviction but also a total fine of nearly Rs 24 crore. These residents have been fighting against their eviction since 2018 in the Mumbai Port Authority Court of Estate Officer.

The Mumbai Port Authority leased its land to several companies and enterprises, which allowed its labourers to reside on the land. In 1990, the port operations shifted to Nhava Sheva port, leading to closure of most of the companies and godowns in Mumbai Port Authority land. While the companies closed their operations and shut down their docks, the workers continued to live there. As land was vacated by these companies, more and more families started settling on the land. As a result, thousands of slum dwellers got settled on the Mumbai Port Authority land, located on the eastern coast of Mumbai. Many of these homes are over 80 years old but the owners have no rights for protection against evictions and rehabilitation.

In 2018, Nitin Gadkari, then Minister of Shipping announced his intentions to allow real estate and other developments on land owned by Mumbai Port Authority. The Mumbai Port Authority also prepared a development plan for the land highlighting the proposed redevelopment of land. Since then, the authority has been sending eviction notices to slum dweller under the section 5 and 7 of Public Premise Eviction of Unauthorised Encroachments Act 1971.

The authority has also imposed fines and arrears of pending lease amount on slum dwellers for occupying its land. In some cases, like in H Block, the authority has also imposed the fine of the company that had leased the plot to slum dwellers, taking the total amount to nearly Rs 24 crore. When the slum dwellers approached the Office of Estate Officers Court of Port Authority, the authority upheld the eviction and the fines imposed.

When the people received the above order, they immediately asked for the intervention of Member of Parliament Arvind Sawant from their constituency. However, the port trust maintains that they do not have any rehabilitation policy for encroachers and therefore, rehabilitation or protection against evictions is not possible for such residents.

As on 23 February 2026, the port authorities were yet to conduct their eviction drive.
