Farmers and khatedar tenants of Jambheswar Nagar-II village in Bap tehsil of Jodhpur district in Rajasthan objected to the right-of-way for the establishment of towers and transmission line for providing connectivity system of Rajasthan Solar Park Development Company Limited for 925 MW Solar Park in Nokh village in Pokaran tehsil in Jaisalmer. The transmission evacuation system is being set up by Rajasthan Renewable Energy Corporation Ltd (RRECL) in Bap tehsil.
A Gazette notice, published on 26 October 2021, notified villages along the proposed route. However, the route was later altered to include land parcels in Ranjeet Nagar and Jambheswar Nagar-II that were not included in the original Gazette. Landowners alleged that were only intimated after the change occurred. Despite a representation to the Sub-Divisional Officer (SDO) of Bap Tehsil—whose report recommended against the allocation—the project proceeded. The landowners then challenged the land allocation in court.
The landowners alleged procedural violations, specifically that the amended route was never advertised in a newspaper of wide circulation and their land had already been converted and leased for private solar projects and approved by responsible government authorities. In response, the company argued that while both villages were administratively separated from Badi Sidd in 2008, they remained part of the sanctioned route under the "umbrella" of Badi Sidd due to their proximity. Further, the route was formalised following the Central Electricity Authority (CEA) approval and a 2023 public notice. Legally, the company relied on Sections 20A and 41(ha) of the Specific Relief Act, 1963, which restrains courts from granting injunctions that interfere with scheduled infrastructure projects, such as electricity transmission.
Consequently, the court sided with the respondent. The court reasoned that the newly formed Jambeshwar Nagar-II and Ranjit Nagar were part of Badi Sidd prior to their formation and are still adjoining Badi Sidd, therefore, could cover the disputed area. While dismissing the petition, it noted that the land situated in and around the vicinity of Badi Sidd has always been part of the proposed transmission system.
In 2023, the petitioners appealed to the division bench of the High Court against the order. The High Court recognised that the name of the villages was not mentioned in the public notice issued while notifying the route for the transmission line and stated that the matter requires more consideration. However, the court refused to grant an injunction and listed the matter for further hearing.
