Land Conflict Summary

In September 2013, the then Prime Minister Manmohan Singh announced an airport at Kishangarh in Rajasthan's Ajmer District. Ever since, there has been conflict over the procedure and compensation offered for land acquisition. The land acquired for the project was a twocrop, irrigated and fertile land. Due to water collection work in the upper area, a canal and a waterrecharge in the wells contributed to the water needs for farming and pastures there. Animal husbandry and dairy work provided sustainable livelihood to the people. Farmers say the administration did not inform either the panchayat, or the gram sabha about the land acquisition process. The administration published notices in Urdu and Sindhi newspapers, which have minuscule readership in the area. The farmers claim that they got to know about the notice only after the last date to file objections had passed. They allege the government forcibly took away their land by declaring their houses illegal. The farmers question the usefulness of an airport in a rural belt and say the areas that are important for tourism and pilgrimage are already well connected. People now demand the promised compensation for their land. They say the government had promised them six times the circle rate for land but had backtracked later. In a memorandum submitted to the district authorities in April 2015, the villagers stated that "according to the DLC rate, the government had promised to pay Rs 1.65 lakh compensation as compensation but is now paying Rs 75, 000 per acre." Farmers in Rathodon Ki Dhanni allege that they did not agree for the land acquisition as the officials offered lesser compensation to them compared to residents in villages falling closer to National Highway 448. In October 2017, the Kishangarh Airport was inagurated. However, land acquisition of villages as per the proposed plan of the Airport is yet to be completed. B S Meena, Airport Director of Kishangarh Airport, did not respond to LCW's email queries on land acquisition issues.

Section 4 [provides that when the government intends to acquire land for a public purpose, it shall conduct a social impact assessment study in consultation with the panchayat to assess the social impact of the project including, inter alia, whether the proposed acquisition serves public purpose, and whether land acquisition at an alternate place has been considered and not found feasible]; Section 11 [stipulates that when land is required for any public purpose, a preliminary notification is to be published by the government in two daily newspapers of which one is in the local language of the area, and the same shall also be published in the panchayat office]; Section 2(2) [Prior consent of affected families for the acquisition of land is required to be obtained by a process determined by the government]; Section 15 [Any person interested in the land being acquired may within 60 days from publication of the preliminary notification object to the area and suitability of land, the justification offered for public purpose or the findings of the Social Impact Assessment report]; Sections 27 and 28 [The total compensation to be paid to the land owner is determined by the collector basis, inter alia, the market value of the land and assets attached to the land.]
