Land Conflict Summary

In 2021, Jammu and Kashmir administration diverted 40 hectares of forestland for the construction of the Jammu High Court complex in Raika forest in the outskirts of Jammu district. Over 38000 trees are likely to be cut for the project. This move will displace at least 40 families belonging to tribal communities. It will also affect the ecological balance of the Raika forest which is home to 150 plant and animal species.

A part of the proposed construction site falls inside the Bahu Conservation Reserve, while another part is close to the Ramnagar Wildlife Sanctuary. Despite this, the administration approved the development of the new court complex inside Raika forest, which is also known as 'lungs of Jammu'.

On October 11, 2019, the proposal by the Law Department of Jammu and Kashmir administration for acquiring the land was put before the Forest Department.

Members of the households who will be directly affected by the project, and local environmental groups like Climate Front Jammu and Environment Awareness Forum have been protesting against the move. The project was also challenged in the National Green Tribunal (NGT), but the NGT dismissed the petition in 2020.

According to a statement released in the media, there is fear amongst people about the possibility of failure of Government's compensatory afforestation plans for the project.

Anmol Ohri, the founding director of Climate Front, an environmental group, actively campaigning to save Raika forest said, "it is the only surviving forest close to Jammu city and has been rightly termed the lungs of Jammu. If massive deforestation happens here, it will harm the air quality of Jammu and in the coming time we’ll be gasping for clean air like other metro cities in India.”

Members of Gujjar communities who have been living in the forests for decades stand to lose their homes and livelihoods by this move.

Ghulam Mohammad, a resident of the affected area, said, “No one told us anything. Officials came here out of the blue one day, surveyed the land and left. We protested when the forest guards started marking the trees.”

K. Ramesh Kumar, chief conservator of forests, Jammu, told LCW that there was no other land available for the construction. As of May 2022, no progress had been made for the construction of the High Court complex.
