Land Conflict Summary

In June, 2022, Jammu and Kashmir administration issued eviction notice to 155 private schools which are functioning on State land. This occurred after changes were made to the Jammu and Kashmir Education Rules, 2010, in April 2022.
This move will affect the education of at least 1 lakh students who are studying in the 155 private schools.
The Jammu and Kashmir administration claimed that the land belongs to state. However, private school owners have termed the government move of making amendments in rules as a proper plan to harm the functioning of schools that provide education at low economic costs.

Jammu & Kashmir administration’s new rules directed the Revenue Department to identity those schools built on the land other than private property in the Union Territory (UT) for de-registration by the Education Department. The Revenue department has a list of private schools and they have asked all the CEOs of the districts to follow the eviction order.
Officers of the School Education Department were directed to stop schooling in all those private schools that were functioning from the State land. The Chief Education Officers (CEOs) of the Kashmir division have received the list of private schools which are functioning from the state or Kahcharai land.

One of the CEO, who wished anonymity told LCW that higher authorities issued the eviction order and asked us to issue certificates so that the enrolled students will be accommodated to other government schools.

The affected schools approached the High Court of Jammu and Kashmir and Ladakh to seek relief from the change in rules. The High Court issued an order for maintaining the status quo against the closing of schools. In its order the High Court stated that the petitioners had prima facie made out a case for interim relief at this stage.

The court order further said that subject to objections that would be filed by the respondents and till the next date of hearing, status quo shall be maintained.

The rules were sought to be amended on April 15, 2022 so as to require schools under this Act to obtain a no-objection certification regarding land use from the Revenue Department, Government of Jammu and Kashmir.
