Land Conflict Summary

In April 2023, the district administration in Panisagar, situated in North Tripura, carried out an eviction drive. Numerous structures were demolished as they were allegedly constructed on government khas land in Rowa.

Government officials allege that 16 families had encroached upon the area. Their removal through the eviction drive led to a reclamation of around 64 acres of government land.

Officials claim that the encroachers were served notices twice in November 2022 and March 2023, in accordance with section 4 of the Tripura Public Premises (Eviction of Unauthorized Occupants) Act 1983.

However, the families residing in the area allegedly refused to comply with the eviction notice.

On 18th April, 2023, the Panisagar Sub divisional Magistrate in an official letter asked the families to clear the land within seven days. In the letter it was stated  "This court has scheduled the eviction of all unauthorized occupants from the land owned by PWD for 11 am on 24th April 2023."

The local BJP MLA Binoy Bhushan Das assured that all individuals who were evicted during the process would receive appropriate rehabilitation.

Tripura Public Premises (Eviction of Unauthorised Occupants) Act, 1983
Section 4 (Estate officer may evict people occupying public premises without authorization by issuing notices in writing to affected persons. The estate officer must give affected persons an opportunity to be heard)
Sudama Singh v. Deepak Mohan Spolia (C.A. No(s). 21806-21807/2017, Supreme Court)
The Delhi High Court in the case had directed that before any eviction, the relevant authority must identify evictees eligible for relocation and rehabilitation. The state authorities must also ensure that basic civic liberties are ensured at the site of relocation. The Supreme Court confirmed this decision and stated that the directions passed in the High Court judgment must be complied with precisely.
