The slum cluster, inhabited by about 1,000 to 1,500 people, around Sunder Nursery near DPS Mathura Road in the Nizamuddin area in Central Delhi was razed down on November 23, 2023.
The eviction drive was carried out after the Delhi High Court ordered the Land and Development Department to demolish and evict the residents of the ‘jhuggi jhopri’ cluster located near Sunder Nursery. Most of residents in the slum cluster work as ragpickers, street hawkers, domestic helps, labourers and small-scale traders.
Nirmal Gorana, convener of Mazdoor Awas Sangharsh Samiti, told NewsClick, "This eviction has caused huge destruction. One expected sensitivity and relief to the poor from the court and the government, but this is not being seen in many recent eviction cases. This means that human rights are being ignored even by the courts, which is a bitter truth. The government should immediately provide shelter to the evicted families and make arrangements for their rehabilitation, otherwise injustice will be done to the last person.”
The slum dwellers were left homeless as the government did not provide them with an alternative space to stay.
As a number of students missed their exams, families questioned how their names were in the voters’ list if their homes were "illegal". They said they had all the documents to prove the registration of their homes. They were also getting electricity and water supply.
During the court hearing, the Centre and the Delhi government clashed over the move to demolish the slum cluster. While the Centre — through landowning agency L&DO — maintained it is duty-bound to demolish the cluster encroaching on public land in compliance with HC’s 2019 order, the state government’s Delhi Urban Shelter Improvement Board (DUSIB) opposed the move, saying the slum dwellers need to be first rehabilitated before demolition since the cluster was in existence prior to 2006 and covered under the slum rehabilitation policy of the Delhi government.
In the plea, residents argued that the ‘basti’ was a notified cluster in DUSIB’s 2012 list and hence, they were entitled to protection under the Delhi Slum & Jhuggi Jhopri Rehabilitation and Relocation Policy, 2015.
