Summary

The case reflects a conflict between the need to maintain navigation through the river, on one hand, and concerns over the potential ecological consequences of dredging in a sensitive coastal area, on the other.

The conflict began when the Captain of Ports Department, Government of Goa, proposed maintenance dredging at the mouth of the Chapora River to maintain navigational access and the safety of fisherfolk in the region. The work was awarded to Enrich Global Infra Limited, which began dredging in December 2025 after receiving the necessary permissions, including a Goa Coastal Zone Management Authority NOC issued on 17 November 2025.

The proposal, however, raised concerns because the mouth of the Chapora River lies close to the Morjim and Mandrem beaches, which are important turtle-nesting sites. The Forest Department had already objected to aspects of the proposal, warning that dredging could affect the stability of the beaches and recommending that an Environmental Impact Assessment (EIA) be undertaken to assess the potential impacts on the nesting sites.

Despite these concerns, the GCZMA issued its NOC, subject to conditions intended to ensure that dredging did not affect turtle nesting and that the work was undertaken in consultation with the Forest Department.

The Captain of Ports Department maintained that the dredging was sufficiently far from the nesting beaches and that sediment generated by the activity would not reach or disturb the nesting sites. He submitted that Chapora was declared a non-minor port in 1967 and that the navigational channel at the river mouth has been periodically dredged to ensure safe navigation for fishing vessels. He maintained that the dredging in question was not a new activity but part of routine maintenance within approved parameters and did not involve any expansion or alteration of the existing navigational alignment that's essential for maritime safety and continuity of fishing operations.

The decision was subsequently challenged before the National Green Tribunal (NGT) by Sagardeep Sirsaikar. The challenge raised concerns about the environmental implications of the dredging and, in particular, the granting of the CRZ clearance without an EIA. The case therefore brought into question whether the environmental safeguards and assessment undertaken before allowing the dredging were adequate, particularly given the proximity of the activity to sensitive turtle-nesting beaches.

The NGT began hearing the matter in February 2026. However, by 17 February 2026, the Tribunal was informed that the dredging activity had already been completed. The NGT directed the CoP and other respondents to file a comprehensive report on the No Objection Certificate (NOC) and clearance granted for the project. The NGT also suggested that environmental damage compensation could be claimed from the authority.
